Almost everyone in trouble does the same thing: goes quiet and hopes. It is the one response that removes every option, because the procedures below run on dates, and the dates start at the first missed payment.

What Kazakh law sets up for you

In general terms, and simplified. Kazakh law provides a settlement procedure: a borrower who cannot pay may apply to the lender, the lender must consider the application and respond, and only after that stage can the debt move on to a collection agency or to court. The exact rules and deadlines depend on the type of loan and the law in force — check the current position or take advice, and do not rely on a website for your own deadline.

What to put in the application

  • Who you are and which loan — full name, contract number and date.
  • What happened — job loss, illness in the family, business collapse, reduced hours. Facts, briefly.
  • What you can actually pay — a realistic figure per month, not an optimistic one.
  • What you are asking for — a payment holiday, a longer term, a lower instalment, or interest frozen for a period.
  • Proof — anything supporting the circumstances, and proof that you submitted it.
If a collector contacts you

Six things they are not allowed to do

Collection activity in Kazakhstan is regulated and collection agencies must be entered in a register. Ask for the agency's name and check it in that register — people claiming to be collectors, who are not, are a separate and common problem. In general terms, the rules prohibit:

Threats or pressureThreats of violence, damage to property or harm to reputation are crimes, not negotiating tactics. Report them to the police.
Calling at nightContact is restricted to defined hours. Repeated calls outside them are a breach, and worth recording.
Endless contactThe frequency of calls and visits is limited. Keep a log: date, time, number, who called and what was said.
Telling other people about your debtDisclosing the debt to relatives, neighbours or your employer without the legal basis to do so is not permitted.
Pursuing people who never signedIf you did not sign as borrower or guarantor, the debt is not yours — say so once, in writing, and keep the copy.
Taking property themselvesA collector is not a bailiff. Seizure of property happens through the legal process, not at your door.
Where to complain: about a collection agency or a financial organisation, to the financial market regulator; about threats, to the police. Keep the call log and any recordings — a complaint with dates and numbers is treated very differently from one without.

i.Will applying to settle hurt my credit history?

Missed payments are recorded regardless. An agreed restructuring is generally a better outcome than continued arrears, and far better than a default that runs for months. Going quiet does not protect your record; it damages it.

ii.The lender refused my application.

Ask for the reasons in writing and what terms would be acceptable. Keep every document. A refusal is a stage in the procedure, not the end of it, and the record of your attempt matters later.

iii.Someone is calling my relatives about my debt.

Write down the dates, times and numbers, ask who they represent, and check that agency in the register. Then complain — to the regulator, and to the police if there are threats.

iv.Can I be jailed for not paying a loan?

Failure to repay a loan is a civil matter, resolved through the courts and enforcement. Anyone telling you that you face imprisonment for arrears is applying pressure rather than describing the law.

v.Someone offers to "clear" my debt for a fee.

Do not pay. There is no paid shortcut, and advance-fee offers are aimed at people already under pressure. Deal with the lender directly, or take advice.

vi.How do I check a lender or collector?

Lenders in the regulator's register of microfinance organisations; collection agencies in the register of collection agencies. Look up the exact legal name yourself rather than trusting a number in a message.
